This Privacy Policy sets out the basis on which any personal data we collect from you, or that you provide directly to us will be processed by us. Please take the time to read the following information carefully to understand our views and practices regarding your personal data and how we will handle it.

GDPR

For the purpose of the General Data Protection Regulation (GDPR), and any subsequent data protection legislation, the data controller is Destination RUN Coaching.

 

Destination RUN Coaching is operated by Andy Stopher and Brian Stopher. For the purpose of this Privacy Policy, Destination RUN Coaching will be referred to when using words such as “we”, “us”, “our”.

 

When referring to “you”, words such as “visitors”, “customer”, “client/s” will also be used.

GDPR

The General Data Protection Regulation (GDPR) - which came into force on May 25th, 2018 - aims to protect the fundamental right to privacy and the protection of the personal data of European Union (EU) citizens. This regulation affects any entity (including websites) that processes EU citizens' personal data.

 

CHANGES TO YOUR PERSONAL DATA

It is your duty to inform us of any changes to your personal data to ensure that any data we hold about you is up-to-date but also accurate. Please use the email address above to inform us of these changes when/if they occur during the period that we are working together.

 

WHAT TYPE OF INFORMATION DO WE COLLECT AND HOW DO WE COLLECT IT?

We may collect the following personal information and data about you in the following ways;

 

Information that you provide to us

You may provide personal data and information (including, name, phone number, email address, home/work address, health/medical data, location data, GPS data, training data) by engaging with us either via our website or through email, text message, phone communication, Final Surge web/app-based software or otherwise. You may give us information when you communicate with us outside of these methods through communication with our website - www.destinationrun.co.uk or through websites, pages and other sources linked directly our website.

 

Information we collect about you

When you visit our website, we collect the Internet protocol (IP) address used to connect your computer to the Internet; login; e-mail address; password; computer and connection information and possibly purchase history. We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information (including date and time, scrolling and clicks) and methods used to browse away from the page. We also collect personally identifiable information (including name, email, password, communications, phone number/s); payment details (including credit card information, if services/goods are purchased through our website or through the purchase of services via inputting of payment details for setting-up of standing orders/direct-debits), comments, feedback, product reviews, recommendations, and personal profile information.

 

Information we receive from other sources

We may receive information about you from a third party through other services or connections we may have or third parties that we work closely with eg. business partners/colleagues, Final Surge web/app-based software, word-of-mouth communications, analytics providers, search information providers and credit reference agencies.

 

HOW WE USE YOUR INFORMATION

 

General

We will only use your information where the law permits us to do so. For the most part, we will use your information in the following circumstances:

 

  • Where we are required to create and carry out a contract/agreement of services that we are about to enter into with you, or have entered into already with you, including Final Surge;

  • Where we required to comply with a legal, statutory or regulatory obligation;

  • Where it is necessary for our legitimate interests (or those of a third party) and your interests to do so and fundamental rights do not override those interests;

  • Where we require your informed consent to process your data;

 

These are known and understood as “lawful grounds”. Please note that we may also process your information for more than one lawful ground depending on the specific purpose for which we are using your data. Information that you provide to us

We may use information that you provide to us in the following ways;

 

  • To allow us to undertake and carry out our obligations for the services for which we are providing and that you have requested us to provide to and for you;

  • To allow us to contact you directly, even if you have not completed the purchase of the services  we provide to enquire why you may not have done so;

  • To set-up your Monthly Coaching Plan on the Final Surge* web/app-based software service used by us and to use this web/app-based software service to a) inform you via email through Final Surge that you and the information provided has been used for set-up, b) to inform you via phone, email and/or text message that this has been done on your behalf;

  • To provide you with information be it promotional or otherwise about other products/services we offer that you may be interested in;

  • To provide you with information about third party products/services/goods that you may be interested in. Existing customers will be contacting via phone, email or text message about these products/goods/services. New customers and where we permit selected third parties to use your data, we (or they) will contact you if you have provided consent for us or them to do so using the communication methods already stated. If you would prefer not be contacted in this way by us or any of our selected third parties, then please inform us of this in writing by emailing us at info.destrun@gmail.com. Please note that it may take up to 30 days to process your request;

  • To provide you (our customers/users) with continual and ongoing customer service, guidance, support and assistance and technical support;

  • To be able to contact you (site visitors/current and future clients) via any of the means stated above to provide you with promotional information, changes/updates to services and personalised updates to services already provided or to be provided;

  • To ensure that content from our website is presented in the most effective manner for you and for your computer or internet-enabled device;

  • To create aggregated statistical data and other aggregated and/or inferred non-personal information, which we or our business partners may use to provide and improve our respective services;

 

Information we collect about you

We will use this information:

  • to administer our website and for the undertaking of internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes;

  • to improve our site to ensure that content is presented in the most effective manner for you and for your computer;

  • to allow you to participate in interactive features of our service, when you choose to do so, including Final Surge;

  • as part of our efforts to keep our site safe and secure;

  • to measure or understand the effectiveness of advertising we serve to you and others, and to deliver relevant advertising to you;

  • to make suggestions and recommendations to you and other users of our site about goods or services that may interest you or them.

 

We may also contact you to notify you regarding the products and services you have purchased, to resolve a dispute, to collect fees or monies owed, to poll your opinions through surveys or questionnaires, to send updates about our company, or as otherwise necessary to contact you to enforce our Terms and Conditions and any agreement we may have with you. For these purposes we may contact you via email, phone, text message and postal mail.

 

Information we receive from other sources

We may combine this information with information you give to us and information we collect about you for the purposes stated above, depending on the types of information we receive.

 

Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall.  

 

All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

 

Wix can store visitors' data in a number of locations.

 

Your personal information may be stored in data centers located in the United States of America, Ireland, South Korea, Taiwan and Israel. We may use other jurisdictions as necessary for the proper delivery of our services and/or as may be required by law.

 

Wix is a global company that respects the laws of the jurisdictions it operates within. The processing of the User Customer Data may take place within the territory of the European Union, Israel or a third country, territory, or one or more specified sectors within that third country, of which, the European Commission has decided that it ensures an adequate level of protection (transfer on the basis of an adequacy decision).

*Final Surge is a web/app-based coaching software that allows training, tracking and communication to occur between coaches and their athletes. This service provides training plans, calendars, notifications, a ‘social wall’, mailbox and message boards to allow this communication to occur. This service also requires information to be supplied from GPS-device software apps to be shared through the app. Customers/athletes are responsible for connecting their GPS-device software to the web/app-based service and have the right to connect/disconnect at anytime.

 

LINKS TO OTHER WEBSITES

Our website may contain links to other websites of interest. However, once you have used these links to leave our site, you should note that we do not have any control over that other website. Therefore, we cannot be responsible for the protection and privacy of any information which you provide whilst visiting such sites and such sites are not governed by this Privacy Policy. You should exercise caution and read the Privacy Policy applicable to the website in question before proceeding to use that website.

 

DISCLOSURE OF YOUR INFORMATION
We may share your information with selected third parties, including;

 

  • Business partners or suppliers for the performance of any contract we enter into with them or with you, including Final Surge;

  • Analytics and search engine providers that assist us in the improvement and optimisation of our site;

 

We may disclose your personal information if we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our terms of use or terms and conditions of sale and other agreements; or to protect the rights, property, or safety of Destination RUN Coaching, our clients or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

 

WHERE WE STORE YOUR PERSONAL DATA

Once we have received your personal data, we will use appropriate procedures and security features to try to prevent unauthorised access and to prevent your information being accidentally lost. We limit access to your personal data to those employed by Destination RUN Coaching and other third parties who have a business need to know, as stated above and with the appropriate consent. They will only process your information on our instructions and they are subject to a duty of confidentiality.


Unfortunately, the transmission of information via the Internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our site. We have put in place procedures to deal with any suspected data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

 

The data that we collect from you may be transferred to, and stored at, a destination outside the European Economic Area ("EEA"). It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers. Such staff maybe engaged in, among other things, the fulfilment of your order, the processing of your payment details and the provision of support services. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy.

 

All information you provide to us is stored on our secure servers.

 

HOW LONG WE WILL KEEP YOUR INFORMATION 

Your personal data is kept for as long as it is necessary for the purposes for which it was collected, eg. supply of products/services, including for the purposes of satisfying any legal, accounting, or reporting requirements. Therefore, after this period data is destroyed, erased or anonymised. 


To decide the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your information, the purposes for which we process your information, and whether we can achieve those purposes through other means, and the applicable legal requirements.


YOUR RIGHTS
Applicable data privacy laws may give rights to individuals in respect of personal data that organisations hold about them, for example to: 

  • Request a copy of the personal data that we hold about them;

  • Request correction of your personal data where there is incomplete or inaccurate information.

  • Object to processing of your information where we are relying on legitimate interest (or those of a third party) and you believe this impacts on your fundamental rights and freedoms. (Note, we may have compelling legitimate grounds to process information which override your rights and freedoms).

  • Request that we rectify, delete or limit the processing of their personal data. Under certain circumstances, you have rights under data protection laws in relation to your information.

  • Request restriction of processing your information in the following circumstances: (a) if you want us to establish the accuracy of your information; (b) where our use of the information is unlawful but you do not want us to erase it; (c) where you need us to hold the information even if we no longer require it as you need it to establish, exercise or defend legal claims; or (d) you have objected to our use of your information but we need to verify whether we have overriding legitimate grounds to use it.

  • Request transfer of your information to you or a third party.

  • Right to withdraw consent where we are relying on consent to process your data.

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.


We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that your information is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

 

CHANGES TO OUR PRIVACY POLICY
We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.
